Sixth District of the African Methodist Episcopal Church v. Kemp
After聽Georgia聽voters turned out in record numbers for the 2020 presidential election and U.S. Senate elections in early 2021, state聽legislators聽passed a sweeping 鈥 and unconstitutional 鈥 voting law that threatened to massively disenfranchise voters, particularly voters of color.聽The 人兽性交 and its allies filed a federal lawsuit聽against the state of Georgia and Gov.聽Brian Kemp.聽
The lawsuit聽challenges multiple provisions of the law, also known as SB 202, including the聽following聽items.聽
- A ban on 鈥渓ine warming,鈥 where volunteers provide water and snacks to people waiting in long lines to vote,听a common occurrence at precincts聽with聽a large population of voters of color.聽
- A聽severe restriction聽on聽the use of聽mobile voting聽units, which have been used聽to address聽a聽shortage of accessible and secure polling locations that聽previously聽resulted in long lines of voters at existing and traditional polling locations.聽聽
- Additional and onerous聽identification requirements for requesting and casting an absentee ballot.聽
- A compressed period for requesting absentee ballots.聽
- Restrictions on the use of secure ballot drop boxes.聽
- Disqualification of provisional ballots cast聽in聽a voter鈥檚聽county聽of residence聽but聽outside聽the聽voter鈥檚聽precinct聽before 5聽p.m.聽Previously,听votes for all the races to which the聽person聽was eligible to vote on that precinct鈥檚 provisional ballot were counted.聽
- A drastic reduction of early voting in runoff elections.聽
The law was聽debated and聽passed by聽both houses of聽the Georgia Legislature and signed by Gov. Brian Kemp, all聽in under seven hours.聽The legislation was passed despite聽state officials praising聽the聽recent elections for their integrity,听safety聽and security.聽
The lawsuit describes how the law violates voter protections under the 14th聽and 15th聽Amendments聽as well as聽Section 2 of the Voting Rights Act.聽It聽also outlines how the 鈥渓ine warming鈥 ban violates the First Amendment right to freedom of expression.聽
The plaintiffs represented in the case include organizations whose get-out-the-vote activities will be negatively impacted by SB 202 and聽people most聽directly聽affected, such as聽Black voters, new citizens, religious聽communities聽and people with limited English proficiency. The plaintiffs聽include: the聽,听,听,听,听,听The Arc of the United States, Georgia ADAPT, Georgia Advocacy Office聽and Southern Christian Leadership Conference.
